University Libraries Code of Conduct

The University of Arizona is a community of scholars and students. One of the requirements of a scholarly community is to be free of disruptive, threatening and illegal behavior. The UA has rules for the conduct of faculty, staff, students and invited guests while on campus, in part to provide an environment conducive to scholarly activity. This code of conduct is in place to help library staff assure the safety of all library users. All patrons using UA University Libraries facilities are subject to this code of conduct.
This list is not comprehensive and the Libraries reserve the right to address perceived negative conduct as necessary.
Violation of any portion of this code, or of any laws, shall subject the offending party to liability for loss or damage, summary suspension or permanent deprivation of the facilities and privileges of the library, or other such disciplinary action.
This code of conduct applies to the following in the University Libraries system:

Article I. Behavior
Per UA Libraries policy, users shall refrain from the following:
Section 1.01 Disruptive Behavior
Engaging in behavior that may be considered disruptive to others including:
1. Talking excessively loud, using audible electronic devices too loudly
2. Rowdiness
3. Using inline skates, skateboards or collapsible scooters (i.e. Razors) in the library
4. Numerous false accusations about the Libraries or individuals in the Libraries are made by the person; wasting library staff time conducting investigations
5. Anything exhibiting a pattern of abuse of library services; specific examples:
a) Continually going from one staff member to another to argue policy
b) Daily excessive requests for supplies not readily available at the desk
c) Hoarding library materials by deliberately misplacing or hiding them
d) Unreasonable demands of staff time
6. Non-threatening erratic behavior
7. Panhandling
8. Users raising their voices at staff
9. Cursing, slandering or making derogatory statements
10. Excessive/unwarranted complaints about other customer’s appearance or behavior;

11. Following another person about the library
12. Solicitation or proselytizing
Section 1.02 Food & Drink
While food and drink are allowed in the Libraries (except where noted), all drinks should be in spill-proof containers, and any food that is likely to leave residue on floors, tables or computers is not allowed (e.g. foods requiring heavy use of napkins, like BBQ, fried chicken, etc.). All users are expected to clean up after themselves.
Section 1.03 Hygiene
Users whose bodily hygiene is so offensive as to constitute a nuisance to other persons shall be required to leave the library. [Kreimer v. Bureau of Police, Morristown, NJ, 958 F.2d 1242 (3d Circ. 1992)]

Section 1.04 Quiet Spaces
The following areas are designated quiet study areas: Main Library 4th and 5th Floors; Science-Engineering Library 1st and 5th Floors.
In these areas, you should:
• limit conversation
• speak quietly
• turn cell phones & beepers to vibrate
• use cell phones ONLY in elevator lobbies
Note to customers: Signs are posted. If a customer or group isn't following this rule you may point it out to them. If you are not comfortable doing so, please report it to a Library staff person. Be sure to give a specific location and descriptive information about the noisy party.
While other areas in the Libraries may not be designated as quiet spaces, customers should still be respectful of others who are trying to use the facility.
Section 1.05 Sexual Offense
Engaging in any sexual offense, including, but not limited to, public sexual indecency, indecent exposure or unwanted or inappropriate touching.
Section 1.06 Sexually Explicit Materials/Images
Arizona Revised Statutes 13-3507 states that it is a violation of the law “to place explicit sexual material on public display, or knowingly to fail to take prompt action to remove such a display from property in his possession or under his control after learning of its existence.” Therefore, if and when library staff become aware that someone is viewing explicit sexual material from a computer in one of our Libraries, either because they receive a complaint or because they themselves have witnessed the incident, may result in a call to the police.
Section 1.07 Sleeping/Loitering
Persons found loitering or sleeping will be asked to leave.
Section 1.08 Smoking
Smoking in any part of the buildings, or within 25 feet of any entrance, exit or air intake to the building.

Section 1.09 Substance Abuse
Section 1.10 Theft
Removing or damaging items not personally owned by the user.
Section 1.11 Threatening Behavior
Threatening any member of the library staff or other library user with intimidating behavior including, but not limited to, abusive language, harassment, threats of violence or physical harm or any other behavior that could be perceived as threatening.
UA Policy: Threatening Behavior by Students 
Section 1.12 Unattended Belongings
Users are solely responsible for their belongings and personal items shall not be left unattended. Any unattended belongings are subject to be taken to the Libraries Lost & Found.
Section 1.13 Videotaping
Videotaping in the Libraries is allowed as long as it is not disruptive to other customers or library operations and has prior approval from the Building Manager.
Section 1.14 Weapons
Arizona Board of Regents policy prohibits the use, possession, display or storage of any weapons, explosive device or fireworks on The University of Arizona campus.

Article II. Access
Per UA Libraries policy, users shall refrain from the following:
Section 2.01 Age
Children under the age of 15 must be accompanied by an adult. The only exception is if the minor is making a bona fide use of the government documents collection.
Section 2.02 Animals
Section 2.03 Bicycles
Section 2.04 Restrooms
Bathing or other misuse of restrooms is not allowed.
Section 2.05 Trespassing
Entering or having a presence in unauthorized areas of the Libraries, remaining in the Libraries after hours, or remaining in the Libraries after being asked to leave.
Section 2.06 Unauthorized Off-hours Access
For the safety of our customers and the security of our collections, when the Main Library and the Information Commons is open 24 hours (during Fall and Spring semesters), it is restricted to current University of Arizona students, faculty and staff between the hours of 1:00 a.m. and 7:00 a.m. During these hours you must swipe your CatCard at the door in order to gain access to the building. You may also be required to provide proof of your status as a current UA student, faculty or staff by a library staff member.
Article III. Identification Usage
Per UA Libraries policy, users shall refrain from the following:
Section 3.01 Failure to Present ID
Not providing a CatCard or other identification to library staff when asked.
Section 3.02 Sharing ID
Allowing others to use their network authentication (UA NetID) or UA CatCard/Library card for library services (circulation, Interlibrary Loan, Document Delivery, off campus database access, etc.) or entry into the building between 1:00 a.m. and 7:00 a.m.
Article IV. Computer Access/Use
As a land grant institution, The University of Arizona Libraries is strongly committed to providing the community full and open access to its rich collections and information resources. This includes access through our computers in the Information Commons. However, as an institution of higher education, current UA students, faculty and staff are our primary customers.
Per UA Libraries policy, users shall refrain from the following:
Section 4.01 Failure to Vacate a Computer Upon Staff Request
All of the Libraries public computers are available on a first come, first served basis, with the following exceptions:
a) Customers may be asked to vacate computers designated for a particular use or clientele (scanning, GIS software, computers outfitted for use by those with disabilities) if they are not using the machines for the intended purpose and there is a legitimate need from another customer.
b) Non-UA users may be asked to vacate their computers by a library staff member, either directly, or through the ReachPlus Alerts computer desktop messaging system (used by desk employees to send messages directly to all computers), should staff determine that current UA students, faculty or staff are waiting for computer access. Failure to do so in a timely manner constitutes an infraction of this Code of Conduct.
Section 4.02 Use of Electrical Outlets
Customers may use available electrical outlets only if the outlets are not servicing library equipment or being used by maintenance personnel. The library is not responsible for any damage, lost data, etc. resulting from power surges, electrical outages and other such acts.
Section 4.03 Use of Libraries Licensed Electronic Resources
Per
UA Libraries Conditions of Use, unauthorized reproduction, publishing or republishing, transfer, alteration and/or any other unauthorized use of the resources is prohibited. Systematic or programmatic copying or downloading is not allowed.
Section 4.04 Using University Libraries Computers for Commercial Use

Article V. Library Materials & Facilities
Per UA Libraries policy, users shall refrain from the following:
Section 5.01 Damage
Damaging library materials that includes, but is not limited to, writing on pages, removing pages, damaging pages, removing security devices or defacing library materials in any way.
Section 5.02 Distribution of Literature
Per
UA Policy and Regulations Governing the Use of the Campus 
, the passing of petitions, distribution of written information, carrying of placards, picketing, sign-up tables or other set-ups are not allowed inside the Libraries without the permission of the Building Manager or other person with authority to grant permission.
Section 5.03 Facilities
Misusing, damaging or defacing library facilities (fixtures, walls, furniture, emergency mechanisms, equipment, temperature controls, etc.).
